Commercial Real Estate Bankruptcy

Mr. Clarke's experience as a Denver metropolitan-area real estate broker, developer, and investor has been particularly useful in representing real estate debtors such as homebuilders, general contractors, subcontractors, commercial builders, land developers, sub-dividers, and homeowners facing foreclosure. Mr. Clarke has also represented numerous commercial building and shopping center owners whose tenants have filed Chapter 7 or Chapter 11 cases in Colorado as well as in New York, Delaware, California and other states. He is also experienced in quiet title actions, lien foreclosure actions, and acquisition of commercial projects in distress.  When commercial leases, construction loans, permanent loans, and home mortgage loans go into default, multiple issues are created under Colorado real property laws and the federal bankruptcy laws. The filing of a bankruptcy petition will stay a pending eviction or mortgage/Deed of Trust foreclosure sale, but for how long is highly dependent on the facts and whether the party in default files a Chapter 7, 11, or 13 case.

Mr. Clarke has over 35 years of experience in working with public trustee and judicial foreclosures, receiverships, and the restructuring of mortgages to avoid loss of equity where possible or to maximize the amount to be gained from a stipulated sale or "short sale" of distressed properties. These issues are often complicated and can involve more than one possible solution. Mr. Clarke can explain the different options as well as the pros and cons of each, allowing you to make the best decision in your particular case.

If you are facing bankruptcy and have commercial real estate issues, continue reading through this site, including checking out some of the links on the Bankruptcy Information Center and Web Resources pages to answer more of your questions. When you are ready, fill out the Business or Consumer Debtor Analysis Form (if you are a real estate borrower or tenant) and submit it. No BCD Form is necessary for real estate lenders or landlords.  The firm will endeavor to contact you within three business days to discuss what happens next.
