Preeminent Colorado Bankruptcy Lawyer

Chapter 7 • Chapter 11 • Preference & Other Litigation • Alternatives to Bankruptcy • Commercial Real Estate

The Law Office of Jon B. Clarke, P.C. was established in 1992.  Before that time, attorney Jon B. Clarke was a shareholder and director of Clarke & Waggener, P.C., a downtown Denver law firm founded in 1966, which moved to Denver Tech Center offices in 1983.  Mr. Clarke's practice is focused on the area of insolvency, particularly Chapter 7 and Chapter 11 bankruptcies, Preference & Other LitigationCommercial Real Estate in Bankruptcy and Alternatives To Bankruptcy. He does not currently represent Chapter 13 individual regular-income debtors, but he can give you names of experienced attorneys in your area who do.

Mr. Clarke has extensive experience in bankruptcy -- he is, in fact, a 2nd generation Colorado bankruptcy attorney -- which has allowed him to create an efficient, web-based procedure that does not require you to make a lot of office visits.  You are already working on obtaining his expertise by (passively) visiting this website.  The Web Resources page is another stop that you may wish to make, for links to outside information that can help you understand the bankruptcy process and answer questions beyond the scope of this website.  BankruptcyAction.com and Findlaw.com are particularly useful self-education websites.   Mr. Clarke has been named a Colorado Super Lawyer, one of only a few consumer bankruptcy lawyers to achieve this distinction.

The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (the "2005 Act") which applies to all cases filed after October 16, 2005, imposes extensive and stringent disclosure requirements on entities (such as Jon B. Clarke, P.C.) providing "bankruptcy assistance" (advice) to "assisted persons" (prospective individual client-debtors).  The 2005 Act necessitates fundamental changes in client marketing, client intake, client consultation, obtaining client information, conducting pre-bankruptcy analysis and culminating in the filing of a Chapter 7, 11, or 13 Petition.  This website has been designed to acquaint you with the sequence of events plus the disclosures and notices required by the 2005 Act before this firm can legally give an assisted person meaningful, personalized advice about his or her own unique situation.

Your first (active) step is to fill out and email or fax us the Business or Consumer Debtor Analysis Form so that we can determine whether you are an individual debtor and if so, whether your debts are primarily business or consumer in nature.  We will then contact you to discuss the type of attorney-client relationship that can then follow.

Mr. Clarke's procedure for accepting clients is described on the Becoming A Client and Debt Relief Agency pages.  While most cases will fall under this procedure, some very complex cases may require additional office meetings or additional work.  Mr. Clarke has over 35 years of experience (see his Lawyer Profile) giving him the skills to handle any level of complexity an insolvent individual or business debtor may bring to him.

Mr. Clarke and his support staff can efficiently handle your bankruptcy case, enabling you to obtain a "fresh start" with no more than necessary disruption to your employment and family life.  Continue reading through this website to see how Mr. Clarke can assist you.
